"Eighteen video tapes of Abu Qatada's sermons were found in a Hamburg flat used by three of the men alleged to have hijacked the planes that crashed into the World Trade Centre, including the leader of the group, Mohammed Atta."

The document also said Mr Qatada also gave "spiritual advice and encouragement to those involved in terrorist plots in Strasbourg and Paris".

"The evidence is clear Abu Qatada supports the overthrowing by violent means of some current governments of Arab countries and their replacement with Islamic states," it stated.

"When their convictions were quashed last week by the Court of Appeal, people were understandably concerned that other prosecutions might be in jeopardy."
Sections 57 and 58 of the Terrorism Act 2000: "Section 57 deals with possession of articles and section 58 deals with collection and possession of information."

Section 58 says: "A person commits an offence if he collects or makes a record of information of a kind likely to be useful to a person committing or preparing an act of terrorism, or he possesses a document or record containing information of that kind."
Section 58 "was never intended to cover documents that simply encourage Islamic terrorism."

Section 57 "makes it an offence to possess an "article" if there is reasonable suspicion that the possession is connected with the "commission, preparation or instigation" of terrorism. This is more broadly worded than the following section and extends to "instigation", or incitement."

"But defence lawyers argued that electronic data was not an "article" within the meaning of section 57. It could only be "information" within the narrower offence created by section 58. In February last year, three appeal judges headed by Lord Justice Hooper granted the students' appeal on this basis."
